LETTER: To LA When They Refuse to Reassess

When a Local Authority refuses to carry out a reassessment of an EHCP, parents are entitled to challenge that decision immediately. The law is clear: under Section 44 of the Children and Families Act 2014, a reassessment must be carried out unless the LA can demonstrate both that the child’s needs have not changed and that further assessment is not necessary to determine the provision required.
