Understanding Welsh Law on Exclusions from Schools and PRUs

In Wales, exclusions from schools and Pupil Referral Units (PRUs) are governed by the Education Act 2002 and detailed in the Welsh Government’s statutory guidance on exclusions (240410). Before excluding a pupil, schools must demonstrate that they’ve exhausted all reasonable steps to support the child—including implementing behaviour strategies, making appropriate adjustments for additional learning needs (ALN), and engaging with multi-agency support where needed. Exclusion must never be the first response to unmet needs. For children with ALN, failure to consider their profile before exclusion may breach both equality law and safeguarding duties. This resource helps Welsh families understand their rights, challenge unlawful exclusions, and demand accountability from schools and PRUs.
